Regulatory Framework

WEpayments operates as a Payment Institution (Instituição de Pagamento) authorized and supervised by the Central Bank of Brazil (Banco Central do Brasil — BCB) under Law 12,865/2013 and its complementary regulations. As a regulated entity, WEpayments must comply with:
  • Law No. 12,865/2013, which regulates payment institutions and payment arrangements within the Brazilian Payment System (SPB)
  • Resolution BCB No. 80/2021 and subsequent updates governing payment institutions
  • Law No. 9,613/1998, which establishes measures for the prevention of money laundering and terrorist financing
  • General Data Protection Law (LGPD) – Law No. 13,709/2018
  • PIX Regulation (BCB Resolution No. 1 of August 12, 2020, and related rules)
  • Resolution BCB No. 277 of 31/12/2022, which establishes requirements applicable to foreign exchange and international payment transactions
As a customer of WEpayments, you may be required to provide information and supporting documentation to ensure compliance with applicable regulatory, compliance, and operational requirements.

Customer Obligations

By using the WEpayments platform, customers agree to comply with applicable Brazilian financial regulations, including:

Know Your Business (KYB)

All business accounts must undergo KYB verification before activating payment capabilities. Required documents include:
  • CNPJ (Corporate Tax ID)
  • Articles of Incorporation or equivalent
  • Proof of address (last 90 days)
  • Identification documents for all Ultimate Beneficial Owners (UBOs) with ≥25% ownership

Ongoing Monitoring

Customers must keep their registration data up to date. Material changes (ownership structure, legal name, address) must be reported to WEpayments within 30 days.

Prohibited Activities

The WEpayments platform may not be used for:
  • Gambling or games of chance (unless specifically licensed)
  • Cryptocurrency exchanges without appropriate licensing
  • Any activity classified as illegal under Brazilian law
  • Transactions associated with sanctioned individuals or entities (OFAC, UN, BCB lists)

Reporting Obligations

WEpayments is required to report to the BCB and COAF (Brazil’s financial intelligence unit) any transactions that:
  • Are suspected of being related to money laundering or terrorism financing
  • Involve unusual patterns that cannot be explained by legitimate business activity
  • Exceed reporting thresholds defined in COAF Resolution No. 36/2021

Sanctions and Enforcement

Non-compliance with these requirements may result in:
  • Transaction blocking or account suspension
  • Reporting to regulatory authorities
  • Termination of the service agreement
